These Terms of Service ("Terms") govern your use of NicheSitePro ("we", "us", "our") and any services you purchase from us. By visiting nichesitepro.com or purchasing a package, you agree to these Terms.

1. About these terms

NicheSitePro is a productized digital services business operated from California, United States. We provide done-for-you affiliate website builds for non-technical clients. By purchasing a package, contacting us about a project, or using this website, you accept these Terms in full.

If you do not agree with any part of these Terms, do not purchase our services. Continued use of the website after Terms are updated constitutes acceptance of the updated Terms.

2. Services we provide

We offer three productized service packages:

• Starter Blog ($1,997) — 10 SEO articles, full WordPress site setup, Amazon Associates configuration, technical SEO, delivered in 14 days.
• Growth Blog ($3,997) — 25 SEO articles, 3 affiliate programs, email capture funnel, 30 days post-handoff support, delivered in 21 days.
• Done & Growing ($6,997) — 50 SEO articles, 5+ affiliate programs, logo + brand basics, 60 days post-handoff support, delivered in 21 days.

The current, definitive scope of each package is listed at nichesitepro.com/#pricing. We reserve the right to update package contents from time to time; the version in effect at the time of your purchase applies to your order.

3. Payment, pricing, and taxes

All packages are one-time payments. There are no recurring fees, subscriptions, or revenue share arrangements.

• Prices are listed in USD and processed by Stripe.
• Payment is due in full at the time of order. Work begins after payment is confirmed.
• Applicable sales tax may be added based on your jurisdiction.
• You are responsible for any tax obligations in your jurisdiction arising from the purchase.

4. Delivery timeline

Delivery timelines are estimates measured in business days from kickoff (the date you complete the niche brief, not the date of payment if those differ):

• Starter Blog: 14 business days
• Growth Blog: 21 business days
• Done & Growing: 21 business days for initial delivery; ongoing monthly content over 3 months after that

We may extend timelines for reasons including but not limited to: client delays in providing required information, niche changes mid-build, affiliate program approval delays beyond our control, or force majeure events. We will communicate any delays in writing.

5. Scope of work and revisions

Scope is defined by the package you purchased. Out-of-scope work (additional articles, additional affiliate networks, design beyond brand basics, custom features, ongoing management beyond included support window) is available at separate pricing on request.

Each package includes one round of revisions on niche/keyword selection (before content writing begins) and one round of revisions on the final delivered site (before handoff is signed). Additional revisions may incur additional fees.

6. Ownership and licenses

At handoff, you own:

• The domain name (registered in your name with your billing)
• The website hosting account (in your name with your billing)
• All content produced for your site (articles, images licensed to you, schema markup)
• All affiliate program accounts (created in your name)
• WordPress admin credentials and all related logins

We retain ownership of:

• Our internal templates, processes, methodologies, and proprietary tools used during the build (these are licensed for your benefit but not transferred to you)
• The NicheSitePro brand, name, and marketing materials
• Generic, reusable workflow components and code that are not specific to your project

7. Refunds and cancellations

• Before work begins (before keyword research phase starts): Full refund minus a $200 administrative fee.
• After work begins: No refunds. Because each build is custom work that consumes our scheduled production time the moment it starts, we cannot resell that time. We will, however, work with you to address any reasonable concerns or off-spec issues with the delivery.
• Niche changes: Free up to the start of keyword research. After that, $300 to swap (because we have to redo the SERP audit and keyword research).

8. Disclaimers — no guarantees of traffic or income

We do not guarantee any specific traffic, search engine ranking, affiliate income, or financial outcome. Anyone who guarantees you will rank #1 on Google or earn a specific monthly figure is either lying or does not understand how SEO and affiliate marketing actually work.

What we DO guarantee:

• Delivery of all specified package contents (articles, setup, configurations)
• Delivery within the stated timeline (subject to delays defined above)
• A technically sound site that loads quickly, has proper schema markup, and is configured per our published build process
• That all work will be done in good faith using practices we apply to our own affiliate sites

Affiliate income is a slow, compounding game. Most affiliate sites earn little or nothing for the first 4-12 months while search engines learn to trust them. Past performance of our own affiliate sites is not indicative of future results for your site. Outcomes depend on your niche, market conditions, search algorithm changes, your post-handoff effort, and many other factors outside our control.

THIS WEBSITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS REQUIRED BY APPLICABLE LAW.

9. Limitation of liability

To the maximum extent permitted by applicable law:

• Our total liability for any claim arising from or related to our services is limited to the amount you paid us for the package giving rise to the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to lost profits, lost data, lost business opportunities, or reputational harm.
• We are not liable for issues caused by third parties including but not limited to: hosting provider outages, domain registrar issues, affiliate program rejections or terminations, search engine algorithm changes, payment processor problems, or breaches by hosting/registrar/affiliate companies.

10. Acceptable use

By using our services, you agree NOT to use them to build sites that:

• Promote illegal goods or services
• Contain sexually explicit material involving minors
• Engage in fraud, deceptive practices, or copyright infringement
• Target regulated categories we do not serve (firearms, controlled substances, gambling without proper licensing, multi-level marketing schemes, get-rich-quick offers, miracle health cures, or similar high-risk verticals)
• Violate Amazon Associates, CJ Affiliate, or other affiliate network terms of service

We reserve the right to decline any project at our discretion, particularly in regulated or high-risk verticals. If we accept and later discover the project violates these terms, we may terminate the engagement and retain payment for work completed.

11. Termination

Either party may terminate the engagement in writing:

• You — before work begins, per the refund terms above. After work begins, the engagement continues to delivery; you may decline to receive the final handoff but the payment is non-refundable.
• Us — if you breach these Terms, violate acceptable use, or fail to provide necessary cooperation. We reserve the right to retain payment for work performed and to terminate any further obligation to deliver.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising from or related to these Terms or our services will be resolved through:

1. Good-faith negotiation first. Both parties agree to attempt to resolve any dispute via direct communication for at least 30 days before pursuing other remedies.
2. Then binding arbitration — if negotiation fails, disputes will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in Orange County, California.
3. No class actions. You agree that all disputes will be brought in your individual capacity, not as part of a class action.
4. Small claims exception. Either party may pursue claims in small claims court in Orange County, California, where eligible.

13. Changes to these terms

We may update these Terms from time to time. The version in effect at the time of your purchase applies to your order. Subsequent updates apply to future orders and to your ongoing use of the website. Significant changes will be posted at this URL with a new "Last updated" date.
